“Far Beyond What the Law Requires”: Apple Appeals EU’s €500M Fine

In a bold move, Apple has launched an appeal against the European Union’s €500 million fine, vehemently asserting that the European Commission’s decision goes “far beyond what the law requires.” This legal challenge escalates the ongoing tension between major US tech companies and EU regulators over digital market control.
The financial penalty was a consequence of the Commission’s finding that Apple had breached the Digital Markets Act by preventing app developers from effectively guiding users to alternative purchasing options outside its App Store. This ruling aimed to foster greater competition and fairness within the digital marketplace.
Despite having recently modified its App Store guidelines to comply with the EU’s mandate and avert daily fines, Apple now claims that Brussels is forcing it to implement “confusing” business terms. The company’s appeal argues that the Commission is unduly dictating its operational framework and imposing conditions that are disadvantageous for both developers and users.
A significant point of Apple’s contention is the EU’s alleged unlawful expansion of the definition of “steering.” Apple claims the Commission is now considering in-app promotions, not just external links, as part of this definition, thereby complicating developers’ ability to offer outside deals.
